'A Strange Inversion Of Constitutional Norms'
From a brilliant analysis by Victor Davis Hanson in the National Review:
The “process” of memorializing Ford’s testimony involved a strange inversion of constitutional norms: The idea of a statute of limitations is ossified; hearsay is legitimate testimony; inexact and contradictory recall is proof of trauma, and therefore of validity; the burden of proof is on the accused, not the accuser; detail and evidence are subordinated to assumed sincerity; proof that one later relates an allegation to another is considered proof that the assault actually occurred in the manner alleged; motive is largely irrelevant; the accuser establishes the guidelines of the state’s investigation of the allegations; and the individual allegation gains credence by cosmic resonance with all other such similar allegations.And there's more:
The lesson of the hearings transcends the Kavanaugh confirmation. We were presented with two radically different and now competing versions of American jurisprudence and due process, one traditional and constitutional, one fluid and revolutionary. It will be up to Americans, ultimately, to decide by which version they wish to conduct their lives.

Kavanaugh Kapade Kharacters Kategorized . . . . .
It can be difficult keeping up with the crazy characters in the Kavanaugh Kapades.
So, we've decided to do a thumbnail sketch of some of them for you -- and we've especially focused on the more nefarious characters in the bunch.
In no particular order, here goes:
Jeff (The Fake) Flake: Sort of like the prairie scarecrow as drama queen. Stay away -- far, far away.
Cooky Chris Coons: The wonky weasel of Wilmington. With a JD and a divinity degree, he can presumably fleece you while he's invoking the almighty.
Ditzy Dianne Feinstein: AKA DIEfei, could be the original Wicked Witch of the West.
Crazy Mazie Hirono: The South Pacific version of DIEfei. Does she use the same bootblack to color her hair?
Schmuckie Chuckie Schumer: We cannot improve on the original warning: Don't EVER get between him and a camera crew. Doesn't quite make us long for Harry Reid, but he's workin on it.

The Kavanaugh hearing is revealing all this to a national audience for the first time; here in New Jersey, we’ve known he is bat-shit crazy for years. Booker’s own confessed teenage groping incident (which he admitted in a column while he was still at Stanford) got a ton of traffic on this site when we brought it back up last week.
More recently? In 2017?
You may’ve forgotten or never knew to begin with, but Booker told the press that Bob Menendez (then under indictment for bribery) MUST be treated as innocent until proven guilty.
There’s still NO corroborated evidence that Judge Brett Kavanaugh did anything untoward, but that hasn’t stopped Booker from calling for his withdrawal.
Menendez escaped prison narrowly via mistrial BUT the Senate ethics committee severely admonished him and ordered the senior senator to repay $1 million in improperly-accepted gifts.
Why Booker lost his faith in the due process and the presumption of innocence in ONE short year is something a mainstream reporter should ask him. I would myself but, as regular readers know, the coward has blocked me on Twitter.

A: "Sometimes people are very, very certain and wrong. In DNA exonerations, you will find many instances where people start out being uncertain... they'll look at some photos and say, 'Well, that one looks the closest, I guess.'
"But by the time they get to trial, they've become vastly more certain, and therefore more persuasive.
"So you see in these cases how someone who is now very certain, was once not so certain. In those cases, we need to ask what made them become so certain."

She's 100% Sure With 0% Evidence, And MORE!

I don’t know who’s house it happened at or even what year it happened. I don’t know if I got there before everyone else or after. I don’t know how I got there or how I got home over 8 miles away (at the age of 15).
My life time friend doesn’t remember any of this ( and the other 3 people I said were there testified under oath they don’t know anything about this).
I have a fear of flying , but have no problem jet-setting all over the world while on vacation. I’ve been on airplanes more in the past two months than most people in a year, but my fear is completely legit.
I don’t know who paid for my hotel and polygraph test( the afternoon of my grandmothers funeral, or maybe it was the next day, who knows). And guess what? I flew there. Oh and that polygraph, it was only two questions, neither of which were about Kavanaugh. But hey, I passed so that’s all that matters. And my PhD in psychology definitely, in no way, helped me with it or my testimony today.
My friends on the beach encouraged me to continue contacting the media with my story (because we were running out of time). I can’t name them, so we’ll just call them beach friends. Yet while giving such great advice, none were willing to be character witnesses. Meanwhile, Judge Kavanaugh had hundreds of character witnesses step up in a matter of days.
My lawyers, out of the kindness of their hearts, are helping me for FREE yet I have a “needed” gofundme page that currently is sitting at $473,622. I’m so desperately in need of help there’s even a second gofundme with $209,987. I promise though I’m not getting anything out of my testimony, that money is just going to cover my expenses.
I’m super smart. I have a PhD and I teach graduate students. I know lots of big words, but it should be totally believable that I don’t understand basic questions.
I was the only person in the United States that didn’t know Congress agreed to come to me instead of me going to DC. They really do care about my flying phobia after all.

So Jeff Flake announced he would vote to advance the Kavanaugh nomination and this is what happened -- he was cornered in an elevator and harassed.
This is the way it is. This is a mob. What the DemocRATS want is mob rule, pure and simple -- those who disrupt, those who threaten, those who get in your face, those who shout the loudest, Those who chase you out of a restaurant or harass you at home, those who bully and harass - they win. Everybody else-- shut up! This is the Democrat prescription. This is what they want America to be.
This cannot stand!
Now it's been reported that the Democrats walked out of the Judiciary Committee's confirmation hearing to hold a news conference! Sounds about right!

Oh, No: DON'T Turn It Over To The Mob!
From a brilliant editorial in the Wall Street Journal:
The female friend Ms. Ford says was at the home the night of the assault says she wasn’t there. The number of people she says were there has varied from four to five and perhaps more, but every potential witness she has cited by name says he or she doesn’t recall the party.
She still can’t recall the home where the assault took place, how she got there or how she got home that evening. She has no witnesses who say she told them about the alleged assault at the time—until she first spoke of it at a couples therapy session 30 years later in 2012. Mr. Kavanaugh’s name doesn’t appear in the notes of her therapist. . . .
This nomination isn’t only about the fate of a single man whose reputation can be discarded like some tabloid celebrity. This is about the future of the Supreme Court and who will control the Senate. If Republicans reject Mr. Kavanaugh based on what we know now, millions of voters will rightly be furious.
But as important, a rejection will bring dishonor to the Senate. It will validate the ambush and smear politics that Democrats are using. And it will turn Supreme Court nominations over to the justice of the social-media mob and the politics of accusation. It’s time for Senators to stand up and confirm Brett Kavanaugh.

The Quick Take On Dr. Ford: Round One . . .
As a PR practitioner I'm compelled to pay attention to the optics: Dr. Ford has the voice and, to some extent, the demeanor of a pre-teen girl.
She uptalks, sort of like a Valley Girl.
She sort of waddles along in this milieu and I would imagine this might make her a sympathetic figure to SOME women, though probably not to most men.
But somehow it all doesn't fit together. It doesn't add up.
This sort of vaguely juvenile vulnerability doesn't always jive.
Because she also says she specifically remembers certain things (and presumably doesn't remember other things) because of "neurons" in her brain. Yet, it needs to be explained to her what "exculpatory" means (remember she holds a Phd.) and she doesn't know who paid for her lie detector test or how her legal bills are being paid. Presumably, all the rest of us know that she was invited to testify in California (so as not to have to fly since she's afraid of flying, or NOT?) but she never knew she was invited to testify on home turf.
She very much seems to know most of what she needs to know and, somewhat curiously, NOT much of anything else.

Released: Kavanaugh's Complete Opening Statement
Supreme Court nominee Brett Kavanaugh's opening statement for a scheduled hearing of the Senate Judiciary Committee, as prepared* for delivery:
Mr. Chairman, Ranking Member Feinstein, and Members of the Committee: Eleven days ago, Dr. Ford publicly accused me of committing a serious wrong more than 36 years ago when we were both in high school. I denied the allegation immediately, unequivocally, and categorically. The next day, I told this Committee that I wanted to testify as soon as possible, under oath, to clear my name.
Over the past few days, other false and uncorroborated accusations have been aired. There has been a frenzy to come up with something—anything, no matter how far-fetched or odious—that will block a vote on my nomination. These are lastminute smears, pure and simple. They debase our public discourse. And the consequences extend beyond any one nomination. Such grotesque and obvious character assassination—if allowed to succeed—will dissuade competent and good people of all political persuasions from serving our country.
As I told this Committee the last time I appeared before you, a federal judge must be independent, not swayed by public or political pressure. That is the kind of judge I am and will always be. I will not be intimidated into withdrawing from this process. This effort to destroy my good name will not drive me out. The vile threats of violence against my family will not drive me out. I am here this morning to answer these allegations and to tell the truth. And the truth is that I have never sexually assaulted anyone—not in high school, not in college, not ever.
Sexual assault is horrific. It is morally wrong. It is illegal. It is contrary to my religious faith. And it contradicts the core promise of this Nation that all people are created equal and entitled to be treated with dignity and respect. Allegations of sexual assault must be taken seriously. Those who make allegations deserve to be heard. The subject of allegations also deserves to be heard. Due process is a foundation of the American rule of law.
Dr. Ford’s allegation dates back more than 36 years, to a party that she says occurred dring our time in high school. I spent most of my time in high school focused on academics, sports, church, and service. But I was not perfect in those days, just as I am not perfect today. I drank beer with my friends, usually on weekends. Sometimes I had too many. In retrospect, I said and did things in high school that make me cringe now. But that’s not why we are here today. What I’ve been accused of is far more serious than juvenile misbehavior. I never did anything remotely resembling what Dr. Ford describes.
The allegation of misconduct is completely inconsistent with the rest of my life. The record of my life, from my days in grade school through the present day, shows that I have always promoted the equality and dignity of women.
I categorically and unequivocally deny the allegation against me by Dr. Ford. I never had any sexual or physical encounter of any kind with Dr. Ford. I am not questioning that Dr. Ford may have been sexually assaulted by some person in some place at some time. But I have never done that to her or to anyone. I am innocent of this charge.
*We thought this would be Judge Kavanaugh's complete statement at the time. Obviously (and to his great credit) he had much, much more to say. His testimony was a total triumph -- a true tour de force. He was devastatingly effective!

The Troubled Past Of Newest Kavanaugh Accuser
Julie Swetnick, the newest accuser of Judge Kavanaugh seems to have a contentious and troubled background, including some legal skirmishes. From the Wall Street Journal:
In 1993, she [Swetnick] filed a criminal harassment complaint with state prosecutors in Maryland against a podiatrist and his wife, alleging repeated phone calls, according to court records, but the case was withdrawn two months after it was filed.
In 2001, Ms. Swetnick was the defendant in a domestic-violence case filed by Richard Venneccy in Miami-Dade County, Fla. The case was dismissed when both parties failed to appear in court in March of that year, according to court documents reviewed by the Journal.
Roughly a decade ago, Ms. Swetnick was involved in a dispute with her former employer, New York Life Insurance Co., over a sexual-harassment complaint she filed, according to people familiar with the matter. Representing her in the complaint was the firm run by Debra Katz, the lawyer currently representing Dr. Ford. The company ultimately reached a financial settlement with Ms. Swetnick, the people said.
A spokesman for New York Life confirmed that Ms. Swetnick worked there as an agent for less than two years, from 2006 to 2008. She didn’t list her work there on a résumé posted online. . . .
Records show Ms. Swetnick also had recent run-ins with tax authorities. In 2015, Maryland’s comptroller filed a lien against her in Anne Arundel County, a suburb of Baltimore and Washington, for more than $30,000 in unpaid taxes. The state demanded about the same amount in interest and penalties for a total bill of $62,821. The state released the lien in 2016.And then there's this from Swetnick's ex-boyfriend, via Politico:
In 2017, the Internal Revenue Service filed a lien on Ms. Swetnick’s Washington apartment for $40,303 in unpaid taxes, and released it in March, saying the tax bill had been paid.
“Right after I broke up with her, she was threatening my family, threatening my wife and threatening to do harm to my baby at that time,” her former boyfriend said in a telephone interview with POLITICO. "I know a lot about her.”
"She’s not credible at all,” he said. “Not at all.”

Mailer Shows Voters How To #WalkAway Now!
With a mailed voter registration form, the Pennsylvania Republican Party is encouraging Pennsylvanians registered as Democrats to switch to the Republican Party if they are fed up with: their party’s race to the socialist left, the Democratic Party’s condoning of violent extremist group Antifa, seeing extreme candidates hijacking their Party, or seeing leaders time and again propose tax increases.

In response, Republican Party of Pennsylvania Chairman Val DiGiorgio, made the following statement:
“Across Pennsylvania, we continually hear about disillusioned Democrats who feel they are no longer at home in their Party.
“Democrat leaders and Party bosses are no longer able to rationally argue over pertinent policy positions dealing with government spending, tax rates, and welfare reform since they have become a Party that is racing to the socialist left, have embraced open borders, and continue to try and insert government in previously-uncontemplated aspects of American lives.
“The Pennsylvania Republican Party wants to let disillusioned Democrats know they have a home in the Republican Party, which stands for limited government, respect for the rule of law, and fiscal accountability.
“In order to make the switch as easy as possible, voters can fill-out and return the mailed form to their county voter registration office, or simply go to www.VotesPA.com to switch their Party registration."

Yet Another List Where NJ Ranks Dead LAST!
Senate Republican Leader Tom Kean said that $1.5 billion in tax increases imposed by New Jersey Democrats this year have cemented the Garden State’s last-place ranking in the Tax Foundation’s newly released 2019 State Business Tax Climate Index.
“Nobody should be shocked that raising business and income taxes by more than $1 billion would hurt New Jersey’s competitiveness,” said Kean. “What’s shocking, however, is how New Jersey Democrats fail to see how their destructive policies hurt middle-class families who may lose jobs, raises, and an opportunity to build financial security.”
According to the Tax Foundation, New Jersey has dropped from 42nd to 47th place in state rankings of corporate taxes since last year, and from 48th to 50th in individual income taxes. Both are key components that contributed to the state’s overall 50th place ranking for business tax climate.
Kean said that additional legislative changes (S-2989) to the corporate business tax (CBT) being rushed by Democrats this week would exacerbate the problem.
“Even after this last-place ranking, New Jersey Democrats are continuing their efforts to cement the Garden State’s reputation as a bad place to do business,” added Kean. “Their new CBT legislation represents another policy shift that again changes the state’s tax treatment of some of our largest employers after major changes imposed several months ago. This continued instability in our state’s tax policy poses a very real threat to New Jersey’s efforts to retain employers when those businesses can find more predictable and tax-friendly environments in other states.”
